HIGH COURT OF DELHI
W.P.(C) 8366/2026
SHRI SURESH KUMAR RAJPUT .....Petitioner
Through: Mr. Harish Kumar Karwal with Mr. Dhurendra Singh, Adv.
Through:
HON'BLE MR. JUSTICE VINOD KUMAR
ORDER (ORAL)
20.07.2026 C. HARI SHANKAR, J.
44897/2026
JUDGMENT
1. This review petition seeks a review of judgment dated 6 July 2026 passed by this Bench.
2. Mr. Karwal, learned counsel for the petitioner has re-urged in the review petition, all the submissions, which were earlier advanced in the writ petition. He has also handed over written submissions. His emphasis is on the fact that his client happens to be a person suffering from 81% disability. He, therefore, reasserts his submission that it would be unjust to relegate his client to the Tribunal.
3. We have considered all these submissions in the order passed by us. It is settled that a review petition is not a second bite at the cherry.
4. While the order was in dictation, Mr. Karwal injects to advance yet another submission. He submits that one Division Bench of this Court cannot undo a decision of another Division Bench. He submits that as the aspect of whether this Court should exercise jurisdiction in the face of the remedy available before the Court, was taken up before the Vacation Bench, which was also a Division Bench, and which did not hold that this Court had no jurisdiction, this Bench could not have taken a contrary view.
5. We are unable to agree with the submission. The Vacation Bench did not return any decision even tentatively on the aspect of whether this Court could exercise jurisdiction in the face of the judgment of the Supreme Court in L. Chandra Kumar v. Union of India[1].
6. It is keeping in mind the fact that the petitioner happens to be a person suffering from disability, that we have, instead of relegating the petitioner to file a fresh petition before the Tribunal, given him an option, if he so chooses, to have the papers of this Court transmitted to the Tribunal, which would take up the matter from where it stands today. Mr. Karwal emphatically submits that he does not intend to do anything of the kind. We have noted the submission.
7. No case is made out for us to review our judgment dated 6 July
2026.
8. This review petition is, accordingly, dismissed.
