JUDGMENT
1. The petitioner seeks directions to the State authorities/police authorities to place on record the investigation carried out by them till now and direction to add appropriate sections in case FIR No. 132/2026 of PS Kotla Mubarakpur, New Delhi.
2. Learned counsel for petitioner submits that what is sought by petitioner is not monitoring of the investigation, which would be the prerogative of the concerned Magistrate, and what is sought is to point out Date: 2026.07.23 17:13:32 +05'30' W.P.(CRL) 2151/2026 pages that apparently the local police is trying to help the assailants by registering the assault as simple hurt whereas according to the allegations, it was a case of attempt to commit culpable homicide not amounting to murder. Learned counsel for petitioner has taken me through FIR as well as photographs of the injured petitioners, according to which the accused persons assaulted the injured with rod and some pointed object on head. It is contended by learned counsel that the injury was caused on vital part of the body, so cannot be treated as a simple hurt. That, according to learned counsel for petitioner justifies transfer of investigation.
3. Learned ASC assisted by IO/SI Ashwani appearing on advance intimation accepts notice and submits that they shall consider to incorporate appropriate provision of law in the chargesheet.
4. Learned counsel for petitioner submits that this would satisfy the petitioner.
5. Accordingly, the petition stands disposed of.
