JUDGMENT

1. After some arguments, learned counsel appearing for the petitioner submits that he shall file an appeal before the Appellate Authority under the Payment of Gratuity Act, 1972 (“Gratuity Act”).

2. However, he submits that since the petitioner is already facing recovery proceedings, he may be protected for a period of two (02) weeks, so that the petitioner can approach the Appellate Authority.

3. Accordingly, considering the submissions made before this Court, in order to enable the petitioner to approach the Appellate Authority, and file the statutory appeal thereto, it is directed that for a limited period of two (02) weeks, the recovery proceedings, including the Notice dated 16th June, 2026, issued by the Assistant Collector Grade-II, Office of the District Magistrate, District New Delhi, shall remain stayed.

4. It is clarified that this Court has not expressed any opinion on the merits of the case, which shall be considered by the Appellate Authority.

5. Accordingly, all rights and contentions of the parties, including, the issue of limitation, shall be taken up by the Appellate Authority.

6. With the aforesaid directions, the present petition, along with the pending applications, is disposed of. MINI PUSHKARNA, J JULY 24, 2026
