JUDGMENT
1. The accused/applicant seeks regular bail in case FIR No. 123/2026 of PS Sunlight Colony for offence under Section 20/29/61/85 Narcotic Drugs Psychotropic Substances Act.
2. Broadly speaking, the allegation against the accused/applicant is that 1.264 kg ganja was recovered from her. The accused/applicant was initially granted interim bail by the trial court, but the extension thereof was declined. Thereafter, the accused/applicant filed another application for Date: 2026.07.24 17:05:00 +05'30' extension of interim bail before this Court and that was withdrawn since originally the interim bail had not been granted by this Court. It is submitted by both sides that the accused/applicant surrendered on 13.07.2026.
3. Learned counsel for accused/applicant submits that the quantity of ganja allegedly recovered from her is nearing the small quantity and the accused/applicant being a lady, looking after her old aged mother, she deserves bail.
4. Learned APP for State assisted by IO/SI Yashpal accepts notice and in all fairness submits that commercial quantity of ganja is 20 kg and small quantity thereof is 1kg while the quantity recovered from the accused/applicant was 1.264 kg.
5. Keeping in mind the above circumstances, especially the fact that the accused/applicant is a lady taking care of her old aged mother and that the quantity of ganja allegedly recovered from her was slightly above the small quantity, I find it a fit case to grant bail to the accused/applicant.
6. Therefore, the bail application is allowed and accused/applicant is directed to be released on bail subject to her furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Trial Court. st=Delhi, Date: 2026.07.24 17:04:50 +05'30'
7. A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
8. Accompanying applications also stand disposed of.
