JUDGMENT
1. The present petition has been filed alleging wilful disobedience of the order dated 19th April, 2016, passed by this Court in W.P.(C) 8501/2005 titled as B.L. Wali & Ors. versus Union of India & Ors.
2. Vide order dated 19th April, 2016, the following directions had been issued: “xxx xxx xxx
9. Accordingly, the petition is disposed of,
(I) by making the interim orders in force absolute;
(II) by further directing the Government of State of Jammu &
Kashmir to, every six months, have the properties aforesaid of the petitioners inspected by the Deputy Commissioner, Anantnag, Kashmir and if finds any encroachment thereon, to have the said encroachment removed;
(III) by directing the Resident Commissioner at Delhi of the
Government of State of Jammu & Kashmir to upon the petitioners approaching him, furnish to the petitioners the report of such inspections from time to time;
(IV) by directing the Union of India to use its good offices to ensure compliance of the aforesaid directions by the Government of State of Jammu & Kashmir. xxx xxx xxx”
3. A Report has been filed on behalf of the District Magistrate (“DM”) Anantnag, wherein, it is stated as follows:
4. Perusal of the aforesaid report filed by the DM, Anantnag, shows that the subject property of the petitioner at Verinag, Kashmir is safe and free from all encumbrances, and one of the co-sharers, namely, Mr. Sunil Wali, nephew of the petitioner, is in possession of the said property.
5. Learned counsel for the Government of Jammu and Kashmir undertakes, that the directions as contained in the order dated 19th April, 2016, shall be complied with, and the property in question shall be inspected, every six months, in terms thereof.
6. A Periodic Report shall be sent by the DM, Anantnag to the petitioner, on the E-mail, which is reflected in today’s order.
7. Noting the aforesaid, no further orders are required to be passed in the present petition.
