Sandeep Dhingra v. Union of India

1. This is an application filed by the petitioner seeking condonation of delay of 48 days in re-filing the appeal.

2. Considering the averments made in the application, the same is allowed and the delay of 48 days in re-filing the appeal stands condoned.

This is an application filed on behalf of the petitioner seeking release of the FDRs bearing Nos. 0235568 and 0235569 of Rs. 30,000/- and Rs.92,400/- respectively, deposited by the petitioner in terms of the directions contained in the order dated 10.04.2018 passed by this Court in W.P.(C) 3484/2018.

5. It is submitted that the requisite charges that were required to be paid W.P.(C) 3484/2018 by the petitioner to the concerned authorities have already been paid. However, FDRs for sums of Rs.30,000/- and Rs. 92,400/-, referred to in Annexure-1 of the present application, were inadvertently made in the name of “Sandeep Dhingra, pledged to A/c Registrar General, Delhi High Court,” and were deposited earlier in point of time, before this Court. However, it is submitted that since the FDRs were not made in proper name, the same were never encashed.

6. It is submitted that there is no outstanding liability towards any government department or any other authority, warranting the continued deposit of the said FDRs in this Court, and the same are ought to be released to the petitioner.

7. Considering the said averments, the present application is allowed.

8. The registry is directed to release the FDRs bearing Nos.0235568 and 0235569 of Rs. 30,000/- and Rs.92,400/- of State Bank of India, SME Branch, Near Railway Road, Gurugram, dated 26.04.2018, in the name of “Sandeep Dhingra, pledged to A/ c Registrar General, Delhi High Court”, for sums of Rs. 30,000/- and Rs.92,400/- to the petitioner.

9. The application stands disposed of in the above terms.
