JUDGMENT

1. This petition has been filed by the petitioners praying for a direction to the respondents to grant them the benefit of Notional Financial Upgradation in the Grade Pay of Rs.5400/- in Pay Band-3, with effect from the date they became eligible for the same, that is, on the completion of four years of service in the Grade Pay of Rs.4,800/in Pay Band-2, along with arrears and all other consequential benefits.

2. The petitioners in support of their claim are placing reliance on the Judgment of this Court in Sushil Kumar v. Union of India & Ors., 2024:DHC:6969-DB.

3. The respondents have issued a Circular dated 06.12.2024, stating that they are waiting for the necessary instruction from the DoPT/BSF Headquarters in this regard. WP(C) 1201/2025

4. Issue notice.

5. Notice is accepted by Ms.Avshreya Pratap Singh Rudy, the learned counsel for the respondents.

6. She submits that the status remains the same, as the instructions have not been received from the Competent Authority regarding the Judgment of this Court in Sushil Kumar (supra).

7. Taking note of the above submission, we dispose of the present petition by directing the respondents to consider the contents of the present petition as a representation of the petitioners. In case the petitioners are found entitled to the relief in terms of our Judgment in Sushil Kumar (supra), the same should be granted to the petitioners within a period of eight weeks from today. However, if there is any order to the contrary passed by the Supreme Court as far as Sushil Kumar (supra) is concerned, our directions would also be equally affected as far as the petitioners are concerned.

8. With the above directions, the present petition is disposed of.
