JUDGMENT
1. The present contempt petition has been initiated pursuant to a reference u/s 10 of the Contempt of Courts Act, 1971 made by the District Judge (Commercial Court)-02, Rohini District Courts, Delhi.
2. The same was occasioned in the context of CS (Comm.) No.85/2024, in which the concerned Court appointed a Local Commissioner. The Local Commissioner attempted inspection on 03.11.2025 and again on 05.11.2025, however, he was denied entry both times by the defendant no.2 / respondent herein. The said obstruction has been confirmed by the report of the Local Commissioner dated 06.11.2025.
3. Subsequently, the District Judge (Commercial Court)-02, Rohini CONT.CAS(C) 9/2026 Courts, Delhi, vide detailed order dated 10.12.2025, recorded dissatisfaction with the affidavit filed by defendant No.2/respondent herein, and held that her conduct amounted to deliberate obstruction of the judicial process.
4. Consequently, the matter was referred for contempt action under Section 10 of the Contempt of Courts Act, 1971.
5. It is informed today that a settlement has been arrived at in the aforesaid Civil Suit i.e., CS (Comm.) No.85/2024 and the same has been disposed of vide order dated 08.04.2026 passed by the District Judge, Commercial Court-02, North-West, Rohini Courts.
6. The respondent herein tenders an unconditional apology for nonadherence / non-compliance with orders passed by the concerned Civil Court and also for obstructing the Local Commissioner.
7. In the peculiar facts and circumstances, this Court accepts the aforesaid unconditional apology.
8. The respondent has also expressed willingness to pay appropriate costs as may be directed by this Court.
9. It is agreed that the respondent will pay costs of Rs.50,000/- to Delhi Legal Services Authority.
10. Taking on record the aforesaid unconditional apology and subject to the respondent paying the aforesaid costs within a period of four weeks from today, the present petition is disposed of. Pending application also stands disposed of.
