JUDGMENT
(oral)

1. Petitioners herein seek quashing of FIR No. 0135/2023 dated 15.05.2023, registered at Police Station Chitranjan Park, for commission of offences under Sections 354/509/323/341/506/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

2. The abovesaid FIR was registered on the basis of complaint made by respondent No.2 who was, at the relevant time residing in Nilgiri Apartments situated at CR Park.

3. There was some dispute related to the parking of the vehicle which CRL.M.C. 4043/2026 2 turned ugly and altercation took place on 13.05.2023 and also on the night intervening on 13.05.2023 and 14.05.2023. According to respondent No.2, she was inappropriately touched and was abused and assaulted. Her husband (respondent No.3) and their family friend (respondent No.4) also received injuries in incident in question.

4. Charge-sheet has already been filed and the case is at the stage of arguments on charge.

5. Fact, however, remains that during the pendency of the abovesaid criminal case, parties were referred to Mediation and they have reached amicable settlement.

6. Reference be made to proceedings dated 24.04.2026 which took place before Mediation Centre, Saket Courts, New Delhi.

7. The petitioners have agreed to compensate the respondents/complainants towards the litigation expenses of Rs.1,70,000/and during course of the consideration, learned counsel for the respondent Nos. 2, 3 and 4 stated that the entire such amount has already been paid in terms of the abovesaid settlement.

8. Respondent No.2 and 3 are present through video-conferencing and are duly identified by her counsel as well as IO. They submit that they have entered into abovesaid settlement voluntarily and without any coercion and influence from any corner whatsoever and therefore, they would have ‘no objection’ if FIR in question is quashed. They also submit that they have already shifted from the abovesaid Society, though parents of respondent No.2 continue to live there.

9. Respondent No.4, who is presently in Amsterdam, has joined the proceedings through video-conferencing and states that he, too, would have CRL.M.C. 4043/2026 3 no objection if the FIR is quashed.

10. Petitioner Nos. 1 to 4 are present in Court and petitioner No.5 has joined the proceedings through video-conferencing.

11. In view of the settlement arrived at between the parties and nature of allegations, continuing with criminal proceedings would serve no useful purpose.

12. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIRs.

13. Consequently, to secure the ends of justice, FIR No. 0135/2023 dated 15.05.2023, registered at Police Station Chitranjan Park, for commission of offences under Sections 354/509/323/341/506/34 IPC, along with all consequential proceedings arising therefrom, are, hereby, quashed.

14. Original affidavits of the parties be submitted to the learned Trial Court within four weeks.

15. The present petition stands disposed of in aforesaid terms.
