JUDGMENT
Matter taken up today as 28.05.2026 was declared a holiday on account of Eid al-Adha.
1. The accused/applicant seeks extension/continuation of interim bail in case FIR No. 344/2025 of Police Station Rajouri Garden, Delhi for offence under Section 318(4)/336(3)/340(2)/338/61(2) /3(5) BNS, 2023.
2. At the outset, learned APP for State assisted by IO/SI Rohit discloses Date: 2026.05.29 17:27:27 +05'30' that the accused/applicant who was to surrender by yesterday has not surrendered and rather, in addition to the present application, she has filed another application for grant of regular bail. According to learned prosecutor, filing of two concurrent bail applications is clearly an abuse of process and has to be deprecated. Learned counsel for accused/applicant admits that despite pendency of this application for extension of interim bail, the accused/applicant has filed another regular bail application.
3. On being called upon to address on this application, learned counsel for accused/applicant submits that appropriate orders may be passed.
4. By way of order dated 09.02.2026, the accused/applicant was granted interim bail mainly on two grounds. Firstly, as on that date, prima facie there was only a bald allegation against the accused/applicant that the complainant de facto “suspected” the role of the present accused/applicant as a conspirator. Secondly, as on that date, infant child of the accused/applicant was suffering with illness. But as on date, neither of those grounds exists.

As on date, according to the investigation carried out so far, a substantial part of the allegedly cheated money was found credited into the bank account of the accused/applicant, which amount has been withdrawn by her. That amount according to the investigation carried out till date is Rs.17,05,161/-. In other words, according to the investigation carried out, it Date: 2026.05.29 17:27:17 +05'30' is no more a case of mere suspicion.
6. As regards the illness of daughter of the accused/applicant, in order to show her illness, there is no reliable medical record, except a single page prescription slip dated 10.04.2026.
7. Considering the above circumstances, especially filing of another regular bail application by the accused/applicant, I do not find it a fit case to grant extension of interim bail granted to her earlier. Therefore, the present application and the accompanying application are dismissed.
8. The interim protection granted to the accused/applicant vide order dated 27.04.2026 was till 28.05.2026 and the same is not being extended. So, the accused/applicant shall surrender before the concerned Magistrate within two days.
