JUDGMENT
1. Petitioner had filed an application in the name of M/s Eye Sciences and had sought empanelment with CGHS for providing services to CGHS Holders.
2. His such request for empanelment was earlier rejected and the petitioner had filed W.P.(C) 8039/2022, which was disposed of by learned Coordinate Bench of this Court vide order dated 05.12.2023 while directing the respondents to consider such application in accordance with law and to pass appropriate orders within a period of eight weeks.
3. The present contempt petition has been filed seeking initiation of contempt proceedings with the averment that there is no decision, as yet. CONT.CAS(C) 2008/2024 2
4. When the present petition was taken up on last date of hearing i.e. 20.12.2024, it was informed by learned Senior Panel Counsel for Union of India that certain additional documents had been sought from the petitioner and that a Screening Committee was going to be constituted which would take a decision in the month of January, 2025 itself.
5. It was in the above said backdrop that the petition was listed today for further consideration.
6. Learned Senior Counsel for the petitioner submits that he has received a communication from respondents whereby it has been intimated that the Screening Committee did hold a meeting on 31.01.2025 and there is a direction to the petitioner to submit an undertaking.
7. Learned Senior Counsel for the petitioner submits that the intention of the respondent is to somehow either delay the matter or reject the request of empanelment by asking for unnecessary and unrelated details.
8. Be that as it may, learned Senior Counsel for the petitioner, on instructions, submits that the requisite details/undertaking shall be submitted with the respondents within two working days.
9. Mr. Rudra Paliwal, learned Government Pleader submits that within three working days of receiving such undertaking, the Committee would take appropriate decision and would also communicate the same to the petitioner.

Learned Senior Counsel for the petitioner submits that in view of the above, without prejudice to his rights and contentions, as per the CONT.CAS(C) 2008/2024 3 instructions, the petitioner is, presently, therefore, not interested in pursuing with the present contempt petition. He, however, seeks liberty to file the same again in case, need so arises.
11. Petition stands disposed of accordingly. Liberty, as prayed, is granted.
