JUDGMENT
1. Mr. Ramesh Rawat, learned Counsel for the petitioner, submits that there are factual errors in the impugned order of the Tribunal.
2. On this court querying as to why, in that case, he did not move the Tribunal for review, he candidly acknowledges that the time for review had expired.
3. Nonetheless, as the case deals with someone who was granted compassionate appointment, as a matter of indulgence, we allow the petitioner to withdraw this writ petition with liberty to move Tribunal for review. WP(C) 4944/2024
4. In case such a review application is filed within a period of 10 days from today, it shall be decided on merits and not be dismissed on limitation.
5. We make it clear that we have not expressed any opinion on the merits of the case or on the merits of the review petition, if any, which would be filed.
6. We also express that the Tribunal while deciding the review application would keep in mind the provisions of Order XLVII of the CPC, which apply to the Tribunal in view of Section 22(3)(f).
7. The writ petition stands disposed of accordingly.
