JUDGMENT
1. Exemption is allowed, subject to all just exceptions. CRL.M.C. 2713/2026
2. Petitioner herein seeks quashing of FIR No. 049/2022 dated 11.02.2021, registered at Police Station Patparganj Industrial Area, for commission of offences under Sections 420/406 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.
3. Respondent no.2, had entered into contract for supply of premium quality of Nitrile Gloves at specified rates. There was some dispute in relation to abovesaid contract since the goods were either not supplied in time, or were found to be of inferior quality. The matter was reported to the police which CRL.M.C. 2713/2026 2 resulted in registration of FIR.

The petitioner herein had sought anticipatory bail and, when such bail application i.e. BAIL APPLN. 3011/2021, was taken up by the learned Single Judge on 20.01.2022, it was apprised that the matter had been amicably settled under the aegis of Delhi High Court Mediation and Conciliation Centre and, while taking note of the settlement terms, anticipatory bail was granted.
5. It is in the abovesaid backdrop that quashing is being sought.
6. It is apprised that the matter is still under investigation and chargesheet has yet not been filed.
7. Petitioner has joined the proceedings through video conferencing.
8. Shri Vaneet Batish, Director of respondent no.2-M/s Benison Healthcare Pvt. Ltd. is present in court and he has been duly identified by the Investigating Officer.
9. When asked, he reiterates the terms of the settlement. He states that as per the Board Resolution dated 04.08.2025 also, the FIR in question is not to be pursued further. He submits that the entire settlement amount of Rs.11,29,900/- has already been received by respondent No.2-Company and, therefore, there is no dispute left between the parties. He states that he has been authorised by respondent No.2-Company to enter into the abovesaid settlement as per the above said resolution and respondent No.2-Company would have ‘no objection’ if FIR in question is quashed.
10. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.
11. Consequently, to secure the ends of justice, FIR No. 049/2022 dated CRL.M.C. 2713/2026 3 11.02.2021, registered at Police Station Patparganj Industrial Area, for commission of offences under Sections 420/406 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed.
12. Original affidavits and MoU of the parties, copies of which have been placed on record in the present proceedings, shall be submitted to the concerned SHO/IO within four weeks from today.
13. The petition stands disposed of in aforesaid terms.
