Komal Verma v. State NCT of Delhi

1. The accused/applicant seeks interim bail for 30 days in case FIR No.178/2025 of PS Uttam Nagar for offence under Section 143(4)/3(5)/61(2) BNS & 81 JJ Act.

2. Broadly speaking, the allegation against the accused/applicant is that she was involved in a racket of child trafficking and to be specific, she allegedly forged an Adoption Deed. The interim bail is sought by the accused/applicant on the ground that being single mother, she has to take care of her two children, who are at crucial stage of education.

3. Learned APP for State assisted by IO/SI Rakesh Kumar accepts notice and strongly opposes the application, disclosing that the trial is being monitored by the Hon’ble Supreme Court.

4. Learned counsel for accused/applicant submits that since the accused/applicant has not met her children since September 2025, on humanitarian grounds, she deserves to be granted interim bail. It is also submitted by learned counsel that elder child of the accused/applicant has cleared 12th standard exams and now has to take up further education while the younger child has cleared 9th standard.

5. Learned APP for State submits that the charges against the accused/applicant are serious and that on such vague grounds, bail cannot be allowed.

6. Most importantly, in my view, the ground on which interim bail is being sought is too generic and is in the nature of perpetuity. It cannot be said that after 30 days there would be no need for children of the accused/applicant to be taken care of. It is not a case of regular bail on merits of the case.

7. Considering the above circumstances, I do not find it a fit case to grant interim bail. The interim bail application and the pending application are dismissed.

8. Copy of this order be sent to the concerned Jail Superintendent for being conveyed to the accused/applicant.
