JUDGMENT
1. The accused/applicant seeks interim bail for two weeks in case FIR No. 718/2022 of PS Mandawali for offence under Section 302/120B/201 IPC.
2. This interim bail application has been listed in this post-lunch session in second supplementary list after mentioning was allowed by the Hon’ble Chief Justice.
3. The regular bail application of the accused/applicant was dismissed as withdrawn on 27.03.2026 after part arguments. Thereafter, this application has been filed for interim bail so as to enable the accused/applicant to attend BAIL APPLN. 1605/2026 pages the marriage of his sister. From order dated 17.04.2026 of the learned trial court, it appears that the accused/applicant has a brother also at home and presence of the accused/applicant is not necessary for the marriage.
4. In the course of submissions, it was suggested that if agreeable, the accused/applicant can be sent in custody to attend the marriage. Learned counsel for accused/applicant took a passover to take instructions. After taking instructions, learned counsel for accused/applicant now submits that family members of the accused/applicant are not agreeable that the accused/applicant attends marriage in custody.
5. Therefore, the application is dismissed. Copy of this order be sent to the Jail Superintendent concerned for being conveyed to the accused/applicant.
