JUDGMENT

1. Mr. Pandey, learned SPC for the petitioners, at the very outset acknowledges that this case is covered by the judgment cited by the Central Administrative Tribunal[1] as well as the recent judgment of this Court rendered in Union of India & Ors. v. Sh Purshotam Dass Sharma & Ors. rendered on 9 April 2026 in WP(C) 4694/2026. He however prays that the costs imposed by the Tribunal may be waived.

2. We note that the costs have been directed to be paid to the ‘Poor Patients Funds under the Aegis of AIIMS’.

3. We therefore waive the costs as imposed by the Tribunal but “Tribunal” hereafter W.P.(C) 5917/2026 request the petitioners, in the interest of impecunious patients who are being treated by the AIIMS, to consider paying the amount as directed not treating it as costs.

4. The petition is disposed of.
