JUDGMENT
1. Petitioners seek quashing of FIR No. 223/2013 of Police Station Bhalswa Dairy for offence under Section 498A/406 IPC on the ground that the complainant de facto (respondent no. 2) has compromised the dispute with the petitioners.
2. Learned APP for State accepts notice and submits that State has no serious objection to this petition. CRL.M.C. 1817/2026 pages
3. Respondent no.2 identified by IO/SI Mahesh Kumawat also accepts notice.
4. Keeping in mind the nature of the present petition, I have spoken in Hindi with all the petitioners present in person as well as respondent no.2 present in person in courtroom. It is submitted by the petitioners and respondent no.2 that now, they have settled all disputes amicably and petitioner no.1 (husband) and respondent no.2 (wife) are living together happily along with their 14 year old son, while petitioners no.2 and 3 are living with their respective families. Petitioner no.1 and respondent no.2 have been living together for past 02 years and intend to continue the matrimony. Respondent no.2 specifically submits that she does not wish to pursue the criminal prosecution of any of the present petitioners.
5. Having spoken with both sides, I am satisfied that it would be in the interest of justice, not to push the parties through a full dress trial. Therefore, the petition is allowed and FIR No. 223/2013 of Police Station Bhalswa Dairy for offence under Section 498A/406 IPC as well as proceedings arising out of the same are quashed.
