JUDGMENT
1. After some hearing, learned Counsel for the appellant seeks leave to withdraw this appeal without prejudice to his rights and contentions in the suit pending before the learned Single Judge and prays that a direction may be issued to the learned Single Judge to expedite trial and decision in the suit.
2. We appreciate this gesture.
3. Accordingly, without expressing any opinion on the merits of FAO(OS) (COMM) 143/2024 the matter and without prejudice to contentions of both sides, this appeal is disposed of as withdrawn.
4. The learned Single Judge is, however, requested to expedite trial in the suit and, if possible, decide the suit within eight months from today.
5. Needless to say, the observations and findings contained in the impugned order would not inhibit the Court while taking a view on the issues involved in the suit.
