JUDGMENT
1. The accused/applicant seeks anticipatory bail in case FIR NO. 154/2025 of PS Mukherjee Nagar for offence under Section 105/333/3(5) BNS.
2. At the outset, learned counsel for accused/applicant submits that on ground of parity with co-accused Nitin @ Chota, the present accused/applicant also deserves anticipatory bail. BAIL APPLN. 1193/2026 pages
3. Learned APP for State assisted by IO/SI Sachin Rathi accepts notice and in all fairness does not dispute that on same ground of parity, coaccused Yogesh and Nishant also were granted anticipatory bail by this Court on 16.03.2026.
4. Broadly speaking, according to prosecution case, a group of boys led by accused Saurabh were chasing the deceased, who in order to save himself tried to jump across from rooftop of one building to another building but in the process fell down and succumbed. One of the members of the said chasing group was co-accused Nitin, who was granted anticipatory bail by the Hon’ble Supreme Court vide order dated 06.02.2026 and on the basis thereof, co-accused Yogesh and Nishant were granted anticipatory bail on 16.03.2026 by this Court.
5. Keeping in mind the above circumstances, the application is allowed and it is directed that in the event of his arrest, the accused/applicant shall be released on bail, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the IO/SHO concerned. Pending application also stands disposed of.
6. The accused/applicant shall join investigation as and when directed by the IO in writing.
