JUDGMENT

1. Petitioner herein is lodged in Central Jail Tihar in relation to three ongoing cases.

2. She, however, has come up with allegations against concerned Jail Authorities.

3. According to her, she has been harassed by the jail staff and there is denial of her valuable rights of adhering to the religious practices and there is also denial of communication with her family members through videoconferencing facility.

4. It is in aforesaid backdrop that she has filed the present petition under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking protection of her fundamental rights W.P.(CRL) 929/2026 2 as undertrial prisoner and seeks initiation of inquiry into the aforesaid allegations.

5. Fact remains that a comprehensive email was sent by her to Superintendent Jail and Director General (Prisons) on 10.03.2026 and so far, there is no decision with respect to the aforesaid communication.

6. Learned Addl. Standing Counsel for State appears on advance notice.

7. After hearing arguments for some time, the present petition is disposed of with direction to respondent no. 2 i.e. Director General (Prisons) to consider the aforesaid representation and to dispose of the same in accordance with law, as expeditiously as possible, preferably within a period of two weeks from today. The outcome thereof be also apprised to petitioner through email.

8. Needless to say, if the petitioner feels aggrieved by such outcome of her representation, she would be at liberty to file petition afresh before this Court.

9. The petition stands disposed of in aforesaid terms.

10. Pending application also stands disposed of in aforesaid terms.

11. A copy of this order be transmitted to Director General (Prisons) for his information and necessary action in the matter.
