JUDGMENT
1. The only basis of this review petition is the recital, in the Result Notice No. 22 dated 6 April 2011, to the effect that the selection process for nomination of candidates under the Post Code 044/07 was complete and stood closed.
2. At the same time, Mr. J.S. Mann, learned Counsel for the respondent, points out that, in the same Result Notice, it is stated that the vacancies under the ST category had not been filed. He submits that in the case of other candidates who had approached the Tribunal in 2011-2012 relief had actually been granted to them. W.P.(C) 3647/2023
3. When we had issued notice on this review petition, Mr. Singh had candidly acknowledged that the aforenoted recital in the order dated 6 April 2011 was not brought to the notice of the Court when the matter was argued.
4. In these circumstances, we deem it appropriate to dispose of this review petition merely with liberty to parties to take up their rival contentions urged in this review petition before the Tribunal when the matter is taken up.
5. We make it clear that it would be open to the review petitioner/petitioner to urge the contentions in this review petition, including the contention that the selection process stood closed on 6 April 2011, before the Tribunal and for the respondent to respond thereto.
6. It would be for the Tribunal to take a view in the matter.
7. We dispose of this review petition with the aforesaid observation.
