JUDGMENT

1. After some hearing, and with consent of learned Counsel for the parties, this appeal is disposed of in the following terms:
(i) The impugned order is quashed and set aside.
(ii) The learned Single Judge is requested to hear IA
34166/2024 finally on 17 February 2026. The date of 10 March FAO(OS) (COMM) 185/2024 2026 would stand accordingly advanced.
(iii) Both the sides would place on record short notes of their submissions, not exceeding four pages each, before the learned Single Judge, at least three days in advance of the next date, to facilitate hearing.
(iv) Neither side would be entitled to take any adjournment on the date fixed by us.
2. We request the learned Single Judge to hear the Order XXXIX application on the said date and decide it on the said date or as soon thereafter as is possible.
3. We have not observed anything regarding the merits of the order under challenge.
4. We also direct that the details stated in para 11 of the order dated 22 August 2024 passed in the present appeal would be placed before the learned Single Judge in a sealed cover.
5. The appeal stands disposed of, in the above terms.
