Manhar Sabharwal v. The State of NCT of Delhi & Anr.

1. All the abovesaid three petitions have been taken up together as these are connected matters.

2. CRL.M.C. 1055/2026 relates to FIR No. 726/2022 dated 01.09.2022. registered at P.S. Ashok Vihar under Sections 323/341/506/34 IPC. The accused in the abovesaid FIR is Mr. Manhar Sabharwal and complainant is Mr. Anil Sabharwal. Charge-sheet has though been filed, charges have yet not been ascertained.

3. W.P.(CRL) 461/2026 relates to FIR No.556/2024 dated 31.12.2024, registered at P.S. Ashok Vihar, under Sections 467/471/34 IPC. The accused therein is Mr. Rakesh Sabharwal, Mr. Anil Kumar Sabharwal and Mr. Karan Sabharwal and complainant is Manhar Sabharwal. No charge-sheet has yet been filed.

4. W.P.(CRL) 481/2026 relates to FIR No.725/2022 dated 31.08.2022, CRL.M.C. 1055/2026 & other connected matters 3 registered at P.S. Ashok Vihar, under Section 354 IPC. The accused in the abovesaid FIR is Mr. Anil Sabharwal and the complainant is mother of Mr. Manhar Sabharwal. Charge-sheet has been filed.

5. It is informed that all the parties, who are even otherwise related, have entered into amicable settlement and are no longer interested in pursuing any of the abovesaid criminal matters.

6. Complainant in W.P.(CRL) 481/2026 has joined the proceedings through video-conferencing and when asked, she submitted that the matter has been amicably settled. She also submits that all the parties are closely related to one another and in terms of Memorandum of Understanding (MoU), to which she is also one of the signatories, she would have no objection if the FIR in question is quashed. Complainant Anil in CRL.M.C. 1055/2016 and complainant Manhar in W.P.(CRL) 461/2016 have also no objection if respective FIRs are quashed.

7. All the complainants have been identified by IO and respective counsel.

8. The MoU dated 18.12.2025 is common with respect to all the abovesaid three matters.

It is also apprised that one Civil Suit i.e. CS(OS) No.584/2022 is also pending before this Court on Original Side and in terms of amicable settlement, the parties have already filed an application seeking passing of a Compromise Decree and in terms of settlement, both the sides would make appropriate statements in said Civil Suit also. Learned counsel for both the parties also inform that one related O.A. i.e. O.A. No.89/2023, would also not be pursued in view of the amicable settlement and similarly, one another FAO i.e. FAO No.306/2023, would also be withdrawn in terms of such settlement. 10. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature.

11. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash all the three FIRs in question.

12. Consequently, to secure the ends of justice, FIR No. 726/2022, FIR No.556/2024 and FIR No.725/2022, registered at P.S. Ashok Vihar, along with all consequential proceedings emanating therefrom, are hereby, quashed subject to petitioners in CRL.M.C. 1055/2026 and W.P.(CRL) 481/2026 depositing cost of Rs. 25,000/- each with Delhi High Court Staff Welfare Fund [Account no. 15530110074442: IFSC UCBA0001553] within ten days from today.

13. The petitions stand disposed of in aforesaid terms.

14. Pending applications also stand disposed of in aforesaid terms.
