JUDGMENT
1. The accused/applicant seeks regular bail in case FIR No. 357/2024 of PS Chitranjan Park for offence under Section 309(6)/310(2)/311/317(3)/209/ 61(2)/3(5) BNS and Section 25/27 Arms Act.
2. Learned counsel for accused/applicant seeks bail mainly on parity with the co-accused persons, two of whom have already been granted bail by way of detailed orders Annexures P-7 and P-8 to the bail application. Besides that, even the trial court has granted bail to yet another co-accused Farid Ali vide order dated 09.02.2026 and copy thereof has been shown. BAIL APPLN. 611/2026 pages
3. Learned prosecutor assisted by IO/SI Narender Singh does not dispute that the role ascribed to the present accused/applicant is similar to that ascribed to the remaining three accused persons namely Laiq Ahmed and Suphiyan Ali as well as Farid.
4. The detailed circumstances in which the said co-accused persons were granted bail are already described in Annexures P-7 and P-8 to the bail application, raising doubt about truthfulness of the contents of the FIR in the light of CCTV Footage, coupled with unexplained delay of two days in lodging the complaint; and the mystery as to why so many armed persons would enter house of a jeweller and flee away after only snatching out an anklet from foot of wife of the complainant de facto.
5. Therefore, the application is allowed and the accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the trial court concerned.
6. Copy of this order be sent to the Jail Superintendent for informing the accused/applicant.
