Raj Kumar v. Alka Sharma & Ors.

1. Petitioners aver willful disobedience of the order dated 4.12.2012 passed by this Court in W.P.(C) 7525/2012 and the order dated 23.11.2012 passed by this Court in W.P.(C) 7284/2012 wherein while issuing notice in the writ petitions and stay applications respondents were directed to maintain status quo with respect to service of the petitioners and the orders dated 26.11.2012 and 22.10.2012, passed by Deputy Registrar (ESTAB), University of Delhi, were stayed.

2. Mr.V.P. Singh, learned senior counsel appearing on behalf of respondents on instructions submits that the orders dated 26.11.2012 and 22.10.2012 were implemented by the time the stay 2013:DHC:8632 was granted and served upon the University, however, senior counsel on instructions submits that in case the petitioners provide the necessary documents without prejudice to their rights and contentions and pleas raised by them in the writ petition the respondents shall permit them to carry out their duties.

3. The matter was passed over once to enable counsel for the petitioners to take instructions in the matter. At the second call, it is agreed by counsel for the parties that the petitioners will provide necessary documents to the respondents without prejudice to their rights and contentions and pleas raised by them in the writ petitions seeking permanent employment. The respondents agree that within two days of submission of the documents the petitioners will be permitted to join their duty. It is agreed by counsel for the parties that this arrangement is subject to further orders which may be passed in the writ petitions and without prejudice to the rights and contentions of both the parties.

4. With the above observations, both the contempt petitions stand disposed of.
