JUDGMENT

1. After some hearing, Ms. Shivangi Kumar, who appears for the review petitioner submits that the MCD would be satisfied if it is clarified that the conformation by this Court, of the rate of interest of 12%, in the judgment under review, would not act as a precedent for the Central Administrative Tribunal[1] when it is taking up the cases which have been remanded by this Court in WP(C) 16947/2024, WP(C) 14406/2024, WP(C) 14500/2024, WP(C) 14647/2024, WP(C) 14677/2024 and WP(C) 15149/2024 and which are listed before the Tribunal on 19 February 2025. “Tribunal” hereinafter REVIEW PET. 69/2025 in W.P.(C) 7668/2024

2. We, therefore, dispose of this review petition with the limited clarification that, while the liability of the MCD to pay interest on delayed payment of retiral dues from the date when the dues are payable is confirmed, insofar as the rate of interest is concerned, the Tribunal, when hearing the matters on 19 February 2025, would not be influenced by the fact that, in the judgment under review, the rate of 12% was upheld by this Court.

3. With this clarification, this review petition is disposed of.
