The appellant/Union of India seeks to assail the orders passed on applications filed by the respondent under Section 9 of the Arbitration &
Conciliation Act, 1996 making notice returnable on 17.1.2013. The appeals haye been filed on 14.1.2013 against the order dated 21.12.2012 and that the date of 17.1.2013 already stands oyer.
We are informed that the pleadings are being completed and the date fixed for hearing is 21.3.2013.
We are also informed by learned counsels for the respondents that, in fact, in case of similarly situated respondents before us eyen the OMPs haye been disposed of leaying it to the concerned arbitrator to yary the interim orders, if so required. It is, thus, submitted that unnecessarily a lot of hue and cry is being made qua the three petitions in the present case as the demands are under the same contract.
We are, thus, not inclined to interfere with the impugned order for all the aforesaid reason^ especially when the learned Single Judge is seized of the matter.
