24.01.2013 By this petition filed under Section 226 of the Constitution of India, r/w. Section 482 ofthe Cr.P.C. the petitioner seeks quashing ofthe FIR NO. 262/2012, under Sections 323/354/506 IPC, registered at Police Station
Vivek Vihar, and the proceedings arising therefi'om.
Addressing arguments on behalf of the petitioner, counsel for the petitioner submits that on 9.9.2012, due to somemisunderstanding, a minor altercation took place between the petitioner and the respondent no. 2 as a result of which, the respondent no.2 made a complaint against the petitioner allegingthat the petitionerhad tried to outrageher modesty.
2013:DHC:7504 Counsel also submits that with the intervention of the respectable persons ofthe society and relatives, both the parties have settled the inter se dispute amicably.
Counsel further submits that since respondent no. 2 is not interested to take any legal action against the petitioner, hence the respondent no.2 has no objection if the proceedings with respect to the FIR No. 262/2012 under
Sections 323/354/506 IPC lodged at Police Station Vivek Vihar, are quashed.
I have heard learned counsel for the parties.
Considering the fact that the parties have amicably settled their inter se dispute and no gmdge remains against each other, therefore, this court is of the view that no useful purpose would be served in keeping the said FIR and the proceedings arising therefrom unnecessaiily alive any further.
Consequently, FIR No. 262/2012 under Sections 323/354/506 IPC lodged at
Police Station Vivek Vihar, and the proceedings emanating therefrom are hereby quashed. s
The present petition stands disposed ofaccordingly.
