30.01.2013 The petitioners have filed the presentpetitions under Section II ofthe
Ai'bitration and Conciliation Act, 1996 for appointment of an independent arbitrator. On the last date, notice was issued to the respondent and the
2013:DHC:8047 learned counsel appearing on behalfofthe respondentsoughttime to file the reply. Reply is notfiled. However,the counselfor the respondent states that without admitting the allegations made in the petition,the respondent has no objection ifa sole arbitrator is appointed by this Court. Both counsel state that their respective clients are notin a position to payfee ofsole Arbitrator more than? 1 lac.
As agreed between the parties, Mr. Vikram Nandi^ajog, Advocate
(Mobile No.9810097083,Chamber No.224,Lawyers'Chambers,Delhi High
Court) is appointed as a sole Arbitrator to adjudicate all the disputes and differences between the paities as mentioned in the petitions,including their clauns and counter-claims. The Arbitrator shall conduct the proceedings under the provisions ofthe Arbitration and Conciliation Act, 1996 and shall give prior notice before commencement ofproceedings. As agreed,total fee ofthe learned sole Arbitrator is fixed at ^ 1 lac which shall be shared by both the paities in equal proportion. The petitions are accordingly disposed of.
Copies of this order be given dasti to the learned counsels for the parties. A copy of the order be also communicated to the learned sole
