The amended memo ofparties is taken on record.
The present joint application has been filed under Order 23 Rule 3 read with Section 151 CPC. The same is duly signed by learned counsel for the plaintiff as well as defendants as well as parties to the litigation. The present application is also supported by affidavits ofthe plaintiff and the defendants.
Both the counsel state that the matter has been compromised between the patiies in accordance with the terms mentioned in paragraphs 9 and 10 q_f the present application. They further assure and undertake to this Court that pa1iies shall comply with the settlement terms mentioned in the present application.
The aforesaid statements, assurances and undertakings are accepted by this
Court and parties are held bound by the same.

2013:DHC:6674 This Court has also perused the compromise application and is of the opinion that the compromise is lawful.
Consequently, the present suit is decreed in terms of the compromise application in particular its paragraphs 9 and 10. Registry is directed to prepare a decree sheet accordingly.
With the aforesaid observations, the present application is allowed. The next date ofhearing is cancelled.
