07.02.2013 These two separate petitions have been filed by the petitioners for quashing of FIR No. 604/2007 dated 10.11.2007 registered against them under Sections 323/147/149/427 IPG with PS Timarpur and FIR NO. 603/2007 dated 10.11.2007 registered under Sections 323/147/149 IPG with
PS Timaipur and criminal proceedings arising therefrom.
Grl. M(M) 2963/2012 has been filed by the petitioners who are accused in FIR No. 603/2007 dated 10.11.2007 registered against them under Sections 323/147/149 IPG with PS Timaipur and Grl.M(M)
2965/2012 has been filed by the petitioners who are accused in FIR NO. 604/2007 dated 10.11.2007 registered against them under Sections
323/147/149/427 IPG with PS Timarpur.
Both the parties are present along with their respective counsels. Both the said cross FIRs are arising out of the same incident which had taken place on 9.11.2007. Gounsels submit that both the parties have amicably settled their disputes and they otherwise are neighbours and residing in the same locality and also belong to the same community. Gounsels also submit that both the parties have taken adecision to maintain cordial relationship with each other and not to indulge into any such kind of quarrel or fight
/ again.
I have heard learned counsel for the parties.
Considering the facts and circumstances of the case that the parties have amicably resolved all their inter se disputes, I am of the view that no useful purpose would be served in keeping the said cross FIRs and the proceedings arising therefrom unnecessarily alive any further against the petitioners. Consequently, FIR No. 604/2007 dated 10.11.2007 registered under Sections 323/147/149/427 IPC with PS Timarpur and FIR NO. 603/2007 dated 10.11.2007 registered under Sections 323/147/149 IPC with
PS Timarpur and the criminal proceedings arising therefrom are hereby quashed.
