08.02.2013 It is not disputed on the part of the appellants that there has been an inordinate delay in recording of evidence and filing of affidavit. Learned counsels assure that the needful has now been done and the trial will proceed expeditiously.
The impugned order being in the nature of only an interim arrangement pending trial, we make it clear that it is no reflection on the merits of the controversy which would be determined post trial. It is agreed that the appeal be accordingly disposed of.
Ordered accordingly.
