ORDER
1. Present contempt petitions have been filed by petitioners under Sections 11 and 12 of the Contempt of Courts Act, 1971, alleging willful disobedience of the order dated 14.5.2012 passed by a Single Bench of this Court in W.P.(C) 7385/2007 [in Cont.Cas(C) 647/2012] and the order dated 14.5.2012 passed in W.P.(C) 18888-89/2006 [in Cont.Cas(C)648/2012].
2. On the last date of hearing, it was informed to the Court that the parties are trying to settle the dispute between the parties and time was sought by counsel for the parties to finalize the terms of the 0-1 2013:DHC:8625 settlement. At the oral request of counsel for the petitioners partners of the firm, M/s Northern Scale Company, were also impleaded as respondents in the present contempt petitions.
3. Parties are present in Court. They have been duly identified by their respective counsel. Parties submit that they have arrived at an amicable settlement. They further submit that as per the settlement it is agreed that the respondents will pay a sum of Rs.3.00 lakhs, in full and final settlement, to each of the petitioners, in the following manner.:
(i) Each petitioner will be paid a sum of Rs.50,000/- by the respondents within one week from today; and
(ii) The balance sum of Rs.2.50 lakhs will be paid by the respondents to each of the petitioners in five equal monthly installments, within five months from today;
4. The respondents undertake to the court that the terms of the settlement will be honoured. The respondents have been explained in Court the consequences of breach of undertaking given to Court.
5. Accordingly, present contempt petitions stand disposed of in above terms, however, liberty, as prayed, is granted to the petitioners to revive the present contempt petitions in case of default of payment by the respondents.
