ORDER
08.03.2013 Counsel for the decree holder submits that the judgment debtor has failed to comply with the directions contained in the order dated 3.8.2007 as defendant continues to use the word 'LOTUS' on the internet, in its corporate name, on invoices with Hindustan Unilever Limited and also the board at the factory. The matter was passed over once to enable the parties to explore the possibility of an amicable settlement.
Parties are present in Court and they have arrived at an amicable settlement and the statement of the parties have been recorded separately.
It is agreed that the settlement arrived at between the parties and the statement made shall be treated as an undertaking to the Court.
Parties submit that they have been explained the consequences of breach of undertaking. The statement made by the judgment debtor is accepted
2013:DHC:7990 and taken on record. The company shall be bound by the statement made by the Director of the judgment debtor who is present in Court and submits that he is authorized to make the statement and bind the company.
The parties shall be bound by the terms of the settlement. In view of the settlement arrived at between the parties, the execution petition along with the application are disposed of.
