Learned counsel for the appellants now states that she does not press the appeal as it is only a prima-facie view ofthe matter based on the material produced before the learned Single Judge and will not prejudice the trial in the suit. She however requests that the question of law involved in the case may be left open.
The appeal is dismissed as withdrawn in the aforesaid terms.
