2013:DHC:8196 iV The allegations in the FIR against the Petitioners are that while the complainant and his friends were playing in the park, Neeraj, Titu @ Jai
Prakash, Rahul @ Rohit and some others were also playing at around 2.15 p.m., suddenly Neeraj came and asked those people as to why they were playing at the saidplace. When Sumeet stopped thosepersons from hurling abuses Neeraj lifted one brick and hit the same on his right eyebrow and started quarrelling. His three friends also grappled them. Jai Prakash @
Titu hit the brother of the Complainant Amit with wicket with the result he sustained injury in the left hand and leg. Bishamber who came to intervene was hit by Rohit @ Rahul with the wicket. Thus the roles attributed to the
Petitioners are for hitting by wickets. The offences under Sections 323/325
IPG are bailable offence however, Section 324 IPG is non-bailable.
In view of the allegations andthe factthat the Petitioners havealready joined the investigation, I deem it fit to grant anticipatory bail to the
Petitioners.
It is, therefore, directed that in the event of arrest, the Petitioners be released on bail on their furnishing personal bond in the sum of Rs. 20,000/- each with one surety each of the like amount subject to the satisfaction of the Arresting Officer/SHO concerned, ftirther subject to the condition that they will join the investigation as and when directed by the Investigating
Officer.
Petitions are disposed of Order dasti.
