25.04.2013 Pankaj Singh and Nagina Singa have moved applications for regular bail. It is urged that they have been falsely implicated in this case. They are in custody since long. Material prosecution witnesses have been examined.
Learned APP for the State has opposed bail.
2013:DHC:6925 Bachha Singh succumbed to ante-mortem injuries caused to him.
Specific allegations have been made against Pankaj Singh for causing injuries to him which proved fatal. The role assigned to Nagina Singa is that he exhorted Pankaj Singh to beat Bachha Singh. Nagina Singa is aged about
70 years. Considering all these facts and circumstances of the case and role assigned to him, and the fact that he is in custody for the last about two years, and the material witnesses have been examined, he (Nagina Singa) is admitted to bail on his furnishing personal bond in the sum of ^ 50,000/- with one surety in the like amount to the satisfaction ofthe Trial Court.
Since there are serious allegations against Pankaj Singh and he allegedly inflicted severe injuries with ^Dandd' to the deceased- Bachha
Singh, I find no sufficient ground to grant him (Pankaj Singh) bail.
The bail applications stand disposed ofin the above terms.
