01.05.2013 By this petition under Section 407 read with Section 482 of Cr. P.C., petitioner is seeking transfer of criminal complaint No.267/KB/ll and
268/KB/ll titled as IFCI Factors Ltd v. Krish International Pvt. Ltd., pending before the Court of Shri Chander Mohan. Metropolitan Magistrate to the Court of Shri Vinod Kumar Meena, Metropolitan Magistrate, Room
No.21, New Delhi Courts Patiala House.
Mr. Dinesh Monga, Advocate appears on behalf of respondent on
2013:DHC:8225 advance notice.
Learned counsel appearing for the petitioner at the outset submits that transfer of these cases from Tis Hazari Courts to Patiala House Courts in any way would not cause any delay in the disposal ofthe other complaint cases.
I have heard learned counsel for the parties and consMering the facts that the petitioner has raised the plea that both the said complaint cases filed by the respondent against the petitioner arises from the same cause of action, and also the fact that both the complaints are at initial stage, therefore in my view no prejudice would be caused to the parties if the transfer of aforesaid complaint cases, as prayed for is allowed. Accordingly, criminal complaint
Nos.267/KB/ll and 268/KB/ll titled as IFCI Factors Ltd v. Krish
International Pvt. Ltd., pending before the Court of Shri Chander Mohan, Metropolitan Magistrate are transferred to the Court of Shri Vinod Kumar
Meena, Metropolitan Magistrate, Room No.21, New Delhi Courts Patiala
House. It is ordered accordingly.
Learned Magistrate is directed to take up both the aforesaid cases on the same date and it is also directed that both the said complaint cases shall be tried as expeditiously as possible without causing any delay. It is also directed that both the cases will be tried independently.
Mi With aforesaid directions, this petition stands disposed of
