CM No.4291/2013 is an application wherein it is stated that parties have settled the matter out of court. It is stated that the claims of the respondent/workman have been settled for asum of ^40,000/- pursuant to settlement and the said payment has been given to him by way ofdemand draft, the details ofwhich have been given in the terms ofsettlement.
The application for disposing ofthe present writ petition in terms of the settlement is signed by both the parties. Earlier the affidavit of respondent was not annexed with this appHcation. However, the affidavit of respondent is submitted today in the court which is taken on record.
Notice ofthe settlement application was sent to the respondent as well as his counsel. However, despite notice having been served on the respondent as well as his counsel, no one had appeared on their behalf on
