14.05.2013 The land of the petitioners is stated to have been acquired vide award number 48/1986-87. They claim to have filed applications on 12.6.1987 for allotment of alternative plots under the Scheme notified by Government of
India for Large-Scale Acquisition Development and Disposal of Land in r Delhi vide its letter dated 2.5.1961. Further land of the petitioners was acquired vide award number 13/91-92. Vide letter dated 29.8.2012. The respondent - Land & Building Department, Govt of NCT of Delhi, while replying to the applications of the petitioners under RTI Act informed them that their applications were lying pending for want of documents mentioned therein. Following are the documents mentioned in the letter dated
29.8.2012:
(a) Payment certificate in original.
(b)Three PP Size photo and three signatures of the applicant duly attested by Gazetted Officer.
(c)LAC certificate from Land Acquisition Collector for which letter was written to the LAC. On 22/3/2000, 8/3/2001 and 20/1/2005. Copy of letter may also endorsed to Shri Braham Singh s/o of Naidar VIII -
Sahpur Jat who did not pursuethe matterwith the LAC concerned.
ORDER
2. According to the petitioners, they submitted documents vide their letters dated 6.9.2012 which was duly received by Land & Building Department vide Diary numbers 3430, 3431 and 3434,. The grievance of the petitioners is that no allotment letter has been issued to them so fer though draft allotment letter has been prepared and is available on the file of the.A 9department. The photocopy of the said draft letter has been filed along with the petitions. According to the learned counsel for the petitioners, this document was supplied to them under RTI Act.
3. It does appear that though the turn of the petitioners for allotment of alternative plot has matured though, the applications have not been put up before tht concerned Committee. In these circumstances, the writ petitions are disposed of with the direction that in case the turn of the petitioners for processing of their applications for making alternative allotment has already matured, the processing of the said applications shall be completed within a period of eight weeks from today and thereafter the matter shall be placed before the concerned Committee at their respective turns. If there is any further deficiency, the same shall be communicated to the concerned petitioner within four weeks from today, who shall remove the same within four weeks thereafter. This, hov^'cver, would be done only if their turn has already matured for processing of their applications. The decision taken on the applications of the petitioners shall be communicated to them within two weeks of such decision being taken.
