30.05.2013 The petitioner has filed the abovementioned petition under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator.
When the matter is taken up today, learned coimsel for the respondent submits that the respondent has no objection if a sole Arbitrator be appointed by this Court to adjudicate the disputes between the parties including thek claims and counter-claims. As agreed, Sh.M.S.Sabharwal,, retired ADJ & Sessions Judge [Ph. No.Ol1-27410613(R), 9711119304(M)] is appointed as sole arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The Arbitrator shall conduct the proceedings under the provisions of the Arbitration and Conciliation Act, 1996 and shall give prior notice before coimnencing the proceedings. Total fee ofthe leamed Arbitrator shall be payable to the tune of?80,000/- which shall be borne by both the parties in equal proportion.
2013:DHC:8130 The petition is accordingly disposed of.
Copies of this order be given dasti to the learned counsel for the parties. A copy ofthe orderbe also sentto the learned sole Arbitrator.
