JUDGMENT
1. Mr. Sannu, learned counsel for DDA, submits that the petitioners herein have cited medical reasons for not depositing the due amount as per the prescribed Schedule. W.P.(C) 11810/2024 & W.P.(C) 12982/2024 2
2. He submits that as per instructions and without prejudice to the rights and contentions of DDA, they are ready to process the request of both the petitioners for allotment, provided they pay penal interest as per the Brochure.
3. He also submits that let the balance payment, if any, and the penal interest be deposited by them within a period of two weeks from the date of communication.
4. Mr. Sannu, learned counsel for DDA, also submits that such communication shall be sent to the respective counsel for the petitioner so as to ensure that there is no communication gap of any kind. He undertakes to send such communication, containing amount further due, inclusive of penal interest, on or before 12.03.2025.
5. Learned counsel for the petitioners also undertake that, as and when, they receive any such communication, they would immediately instruct their respective clients to do the needful, within the abovesaid period of two weeks and they submit that the present petitions may be disposed of in view of aforesaid statement of Mr. Sannu.
6. Needless to say, if such amount is not deposited by the petitioners within the abovesaid period of two weeks to be reckoned from the date of communication, the petitioners would not be entitled to any relief.
7. It is also clarified that the above order has been passed in view of the special circumstances and shall not be, therefore, taken as precedent.
8. Both the petitions stand disposed of, accordingly.
