02.07.2013 The learned counsel for the petitioner has referred to various orders passed in the matter. It appears from the orders that there is delay on one pretext or the other in the further proceedings on behalf of respondent No.l.
I have been informed by the counsel that the next dated of hearing is fixed on 2"'' August, 2013. It is not in dispute that the respondent No.l already
2013:DHC:7411 filed the affidavits of main witnesses in support of its case. Though in the impugned order while dismissing the petitioner's application the learned trial court has given reasons in paras 12 to 14 but considering the overall facts and circumstances, it is expected that the trial court would expedite the matter and record the evidence in the matter on 2^^ August, 2013 which is stated to be listed for plaintiffs evidence.
