ORDER

1. Notice. Notice is accepted on behalf of counsel for respondent no.1 and counsel for respondent no.2. The respondent no.2 is present in person also.

2. By way of this petition, challenge has been made to order dated 03.07.2013 passed by learned ASJ whereby bail granted to petitioner in a case under Section 406/498-A/34 IPG has been cancelled.

3. After some arguments, with the consent of parties, the petition is disposed ofin following terms:- 2013:DHC:8502

(i) It is stated that petitioner shall abide by the terms and conditions of the settlement dated 10.01.2013 which are annexed at page 26 of the paperbook.

(ii) It is submitted that petitioner has already given first instalment of ^1.75 lakhs to the respondent no.2 and the parties shall now file joint petition under Section 13B(1) of HMA within 7 days from today.

(iii) It has also been agreed by respondent no.2 that respondent no.2

(iv) It has been further agreed that the petitioner shall also withdraw the complaint filed by him against the respondent no.2 under Sections 156(3) and 200 Cr.PC before the concerned M.M., which is listed on 31.10.2013, within four weeks.
