Sohana & Anr v. State NCT of Delhi & Ors

1. The present petition has been filed by the petitioners stating inter alia that they are both major and had solemnized their marriage under the Muslim law, of their own free will. It is averred in the petition that the respondent No.3, father of the petitioner No.l is opposed to her marriage with the petitioner No.2 and had extended threats to them. As a result, extension of protection from the police had been sought by the petitioners.

2. On the last date of hearing, notice had been issued to the respondent No.3 and in the meantime, SHO, Yamuna Vihar had been W.p. (CRL) 805/2013 2013:DHC:8087 directed to ensure that protection was provided to the petitioners through the beat staff.

3. A Status Report has been filed by the State, wherein it is stated that the petitioners are residing at the address given by them in the memo of parties and adequate police protection had been extended to them. It is further stated that after filing of the present case, no intimation has been received from the petitioner regarding any threat or assault from any quarter.

4. Learned counsel for the petitioners confirms on instructions from his clients that they have not received any threat from any quarter since the last date of hearing.

5. In view of the aforesaid position, the present petition is disposed of with directions to the local SHO to ensure that protection is provided to the petitioners in case any specific complaint made by •N, them. The telephone numbers of the beat staff and SHO of PS Vivek Vihar shall be made available to the petitioners, if not already furnished. HIMA KOHLI, 3 JULY 18, 2013 mk/rkb
