1. As per the nominal roll of the appellant/petitioner, he has undergone sentence for a period of eight years, four months and seven days and earned remission for a period of one year, five months and ten days and thus his unexpired portion of sentence is two months and ten days (IFP).

2. Counsel for the appellant/petitioner states on instructions from the wife of the appellant/petitioner that the appellant/petitioner does not wish to pursue the present appeal and the CrI.M.C in view of the limited period of the unexpired portion of sentence.

3. In view of the aforesaid submission, the present appeal and the CrI.MC are disposed of. HIMA KOHLI, J JULY 24, 2013
