07.08.2013 This contemptpetition is predicatedon the alleged non compliance of the orders of this Court passed on 10*^ April, 2013 in Writ Petition (C)
No.5329/2012, titled as Pitam Jankalvan Samiti v. Govt. ofNCT ofDelhi and Ors., wherein the following directions were issued:
"For the reasons stated hereinabove, we dispose of this petition with a direction to the respondents to take due action in accordance with law for removal of the new boundary wall, if any constructed on the strength of the permission granted by the concerned SDM. We, however, make it clear that due opportunity of hearing to the concerned person would be given by the respondents before taking action in terms ofthis petition."
Issue notice to the respondentto show cause as to why proceedings in contempt be not initiated against him.
2013:DHC:8622 Ms. Shawana Bari, Advocate, who appears on advance notice, submits that the Tehsildar, Kanjhawala, had proposed to carry out demolition in terms of the aforesaid orders of this Court yesterday, i.e. 6^ August, 2013 at9:00 a.m., and had addressed a letter dated S"'
August, 2013 to the S.H.O. Police Station Begumpur, for adequate police aid for that purpose. She further submits that, in all likelihood, the aforesaid order of this Court has been complied with keeping in view the aforesaid communication.
The statement of counsel for the respondent is accepted by this
Court. In case, for any reason, the police aid sought by the Tehsildar, Kanjhawala, through his aforesaid communication, was not forthcoming and thus obliging the Tehsildar to postpone his action, the S.H.O., Police Station Begumpur, is directed to provide adequate police aid as and when sought by the Tehsildar, Kanjhawala, in this matter.
A complete status report setting down all the actions taken in the matter shall also be filed by the respondent within three weeks from today.
Counsel for the petitioner states that in view of the statement of counsel for the respondent, and also the further directions issued by this Court today, he does not press this petition any further.
The petition is, therefore, disposed off in the above terms.
A copy of this order be given dasti to counsel for the parties under the signature of Court Master.
