23.08.2013 During the course ofhearing, learned counsel for the respondents who appears on advance notice submitted that the property in question has since been sold as the impugned order had relieved it ofthe rigours ofSection 52 ofthe 1ransfer ofProperty Act, and that he would be disclosing the same in the course ofthe proceedings before the learned Single .Tudge.
In the light of this development and after some submissions, Sh.
Mohit Chaudhary, Advocate sought liberty to withdraw the appeal but at the same time approach the learned Single Judge for appropriate orders in the light of the statement made by the respondents/defendants through his counsel.
Liberty granted.
It is open to the appellant to seek suitable orders in the light of the
2013:DHC:7323-DB 7^ statement made by the defendants/respondents. 71ie appeal is accordingly dismissed as withdrawn butwith liberty as stated.
