1. These are appeals under Section 37 of the Arbitration & Conciliation Act against the judgment dated 31.5.2011 passed by the learned Additional District Judge in C.S. (OS) No.401/2009 dismissing the application of the appellant under Section 34 of the Arbitration & Conciliation Act.

2. On the last date of hearing, the learned counsel for the parties stated that they are working out on a settlement and accordingly, the matter was adjourned. An additional affidavit of Mayank Bhatia, s/o Sh. H.G. Bhatia, authorized representative of the appellant company is already placed on record along with settlement deed. 2013:DHC:8018 \...' •

3. It is contended by the learned counsel that in view of various terms and conditions contained in the settlement between the parties, the arbitration award dated 23.12.2008 may be set aside.

4. There is no appearance on behalf of the respondents.

5. In view of the additional affidavit filed by the authorized representative of the appellant, the impugned award dated 23.12.2008 is set aside and the appeals are allowed to that extent..

6. Trial court record be sent back.
