JUDGMENT

1. On the last date of hearing, the parties were referred to mediation. However, the Mediator has submitted a report stating inter alia that the mediation had ended as a non-starter'.

2. The court has interacted with the counsel for the petitioner as also the counsel for the complainant, but at this stage, there does not appear to be any likelihood of the parties arriving at a negotiated settlement.

4. Learned APP for the State submits that on 4.7.2013, the petitioner had returned a car, some blankets, clothes and three jewellery items to the complainant as per the admitted list of stridhan. Learned APP submits that the list of articles prepared by the complainant includes many other articles of stridhan, apart from the car and jewellery returned which are allegedly in the possession of the petitioner and his family members.

Counsel for the petitioner denies the above and states that without prejudice to the rights of the petitioner and subject to final adjustment, if any, the petitioner is ready and willing to pay a lumpsum amount of ?3 lacs to the complainant if granted interim protection. He further states that the petitioner shall co-operate in the investigation and appear before the 10 as and when summoned.

In view of the aforesaid submission and having regard to the submission made by the learned APP, it is directed that in the event of arrest, the petitioner shall be released on bail on his furnishing a personal bond in the sum of ?30,000/- with one surety of the like BAIL APPLN. 1315/2013 Page No.2 of 3 amount to the satisfaction of the arresting officer/IO and subject to the following conditions:

(i) The petitioner shall appear before the Investigating Officer on

(ii) The petitioner shall fully co-operate with the investigation and present himself for interrogation by the 10 as and when required and will not create any hindrance or impediment during the course of investigation.

(iii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person so as to dissuade them from disclosing such facts to the Court or to any police officer.

7. The petition is disposed of. DASTI.
